Federal Bill Would Force VPNs, ISPs, DNS Services to Block Foreign Piracy Sites

Federal legislation would compel VPN providers, ISPs, and DNS services to block foreign piracy sites, but murky wording on what counts as 'from the United States' risks heavy-handed bans.

A proposed federal bill would create mandatory blocking obligations aimed at foreign piracy websites, and it would place the enforcement burden on the intermediaries that connect users to the internet. VPN providers, internet service providers, and DNS services would all be required to block access to infringing sites hosted abroad under the measure, according to Tom's Hardware's report on the draft legislation.

The proposal is notable for the breadth of the intermediary classes it touches. DNS services, the systems that translate domain names into routable addresses, form one layer; ISPs, which deliver connectivity, form another; and VPN providers, which tunnel user traffic through remote servers, form a third. Obligating all three simultaneously means a blocked foreign piracy site would be cut off across the common paths a user might take to reach it.

The bill's most contested element, per the report, is geographic. The legislation hinges on distinguishing sites and services that are 'from the United States' from those that are foreign — but that definition gets murky in practice. Tom's Hardware flags that the fuzzy location rules could trigger heavy-handed bans: without a clear test for where a site, operator, or service counts as being 'from,' blocking mandates risk sweeping in targets well beyond the foreign piracy sites the bill is written to address.

For the intermediary industry, the practical consequence is a compliance mandate spanning consumer VPNs, carrier-grade ISP networks, and DNS resolution infrastructure alike. Each would be responsible for blocking decisions that turn on a location test the draft bill leaves undefined. Until that language is clarified, the legislation as described leaves the entities it regulates — and their users — exposed to the prospect of broad, opaque enforcement.
